Lil Nas X is scheduled to remain in custody throughout the weekend following his arrest on charges including battery against a law enforcement officer, as well as being hospitalized for a reported possible overdose.
The Los Angeles Police Department confirmed to the Daily Mail that the artist, 26, cannot be released through citation due to the nature of the charge and must appear before a judge for potential release.
Officer Cervantes stated: “With the charge 69(a) PC, the arrestee (Hill) cannot be cited out. It is mandatory that he appears before a judge before he is released. This will happen on Monday.”
Under California Penal Code § 69, an individual may be accused of attempting to prevent or obstruct an executive officer from performing any lawful duty, or knowingly resisting the officer through the use of force or violence while the officer is performing such duty, as described by the California Legislative Information website.
The Daily Mail contacted representatives for Lil Nas X, also known as Montero Lamar Hill, for comment but did not receive a response.
According to reports, Mr. Hill’s family is reportedly concerned about his recent behavior and is considering staging an intervention. Early Thursday morning, he was arrested for battery on a police officer and hospitalized for a suspected overdose. Law enforcement sources indicated that he was observed walking in the middle of Ventura Boulevard, wearing only underwear and cowboy boots.
Witnesses reported that Mr. Hill was exhibiting erratic behavior, including singing, speaking about a party, and posing, before allegedly charging at responding officers around 5:50 a.m. Officers took him into custody and transported him to a local hospital. Officer Cervantes of the Los Angeles Police Department confirmed the arrest, stating: “This morning, around 5:50 am, officers responded to the 11000 block of Ventura Blvd for a nude man walking in the street. Upon arrival, the suspect charged at officers and was taken into custody. He was transported to a local hospital for a possible overdose and placed under arrest for battery on a Police Officer.”
TMZ reported that video of Mr. Hill walking down Ventura Boulevard was recorded at approximately 4:00 a.m., and that multiple individuals in the Studio City neighborhood contacted police regarding the sighting.
The LAPD told NBC4 that Mr. Hill threw punches at officers, which prompted the use of force to subdue him. No officers sustained injuries during the incident. According to TMZ, his bail will be set at the upcoming Monday hearing; prior reports indicated that he was being held without bail.
Footage of the incident, reportedly captured by a passing driver, shows Lil Nas X engaging in various actions while walking on the street. According to the recording, he appeared to sing, gesture with his hands, clap, snap his fingers, and interact verbally with the individual filming.
At one point, he placed an orange traffic cone over his head. He addressed the person behind the camera multiple times, issuing statements and instructions regarding their phone and the surrounding environment. Observers noted that he walked along the street, making gestures and verbal remarks about attending a party and other unrelated commentary.
