Brady Kiser, the husband of social media personality Emilie Kiser, will not be subjected to criminal prosecution in connection with the drowning death of their three-year-old son, Trigg Kiser.
The determination was formally announced on Friday by the Maricopa County Attorney’s Office in Arizona, following a recommendation issued nearly two weeks prior by the Chandler Police Department, which had advised the filing of a felony child abuse charge in relation to the May 12, 2025, incident.
According to law enforcement authorities, Mr. Kiser, age 28, was the sole adult present at the family residence at the time of the incident. He was reportedly supervising both Trigg and the couple’s newborn son, Theodore, when Trigg accessed the backyard pool area. The child was later discovered unresponsive.
Trigg Kiser succumbed to his injuries and was pronounced deceased on May 18, 2025, at Phoenix Children’s Hospital.
In an official statement, Maricopa County Attorney Rachel Mitchell emphasized the uniform prosecutorial standard applied to all cases reviewed by her office: the existence of a ‘reasonable likelihood of conviction.’
“Every case submitted to the Maricopa County Attorney’s Office is evaluated using the same standard: whether there is a reasonable likelihood of conviction,” Mitchell stated. “After careful review of the evidence submitted by the Chandler Police Department, it was determined that this case does not meet that standard.”
According to a search warrant affidavit, Brady Kiser informed investigators that he became momentarily distracted while attending to the couple’s infant son, Theodore. During that time, he lost visual contact with Trigg. Upon realizing the toddler was missing, Mr. Kiser initiated a search and subsequently discovered Trigg unresponsive in the backyard swimming pool, after which he contacted emergency services via 911.#newsafro_
